New Lifejacket Requirements In Effect

Date: Nov 24th, 2018 By SMA Law Group
Categories: Boating Accident

If you are an active boater in Pennsylvania, then you know that when November rolls around, there are additional lifejacket requirements. The Pennsylvania Fish and Boat Commission has reminded all state boaters that from Nov. 1 to April 30, they must wear a lifejacket “while underway or at anchor on boats smaller than 16 feet long or on any canoe or kayak.”

Why does the state have these requirements?

Because the temperatures are dropping in our waters and it does not take long for a person to experience sudden cold-water immersion. Lifejackets save lives.

According to the article, almost 80 percent of all boating fatalities occur because of boaters not wearing lifejackets.

At the SMA Law Group, we know that many of our citizens take part in boating activities, whether they do so for work or recreation. Do you know where to turn if you get injured on the water due to someone else’s negligence?
When you need a Pittsburgh boat accident attorney, you can count on our team to help you recover the compensation you deserve.

The Incidents

Boating accidents can happen to those who are recreational boaters as well as to those who make a living on the water.

Maritime Work

People who work on the water face different daily challenges than most workers. Luckily, there are a few laws that protect workers: the Longshore Workers’ Compensation Act and the Jones Act of 1920. In tandem, these laws make sure that those who work on commercial water vessels are taken care of if something goes wrong. They provide for the payment of compensation, medical care, and services of those who are disabled while performing work duties.

Out For Fun

Maybe you have chosen to go out on the water for a fishing trip or for some knee boarding. Regardless of why you go out, the owner and operator of commercial vessels have a duty to ensure your safety. This can include the following:

• Making sure the boat is inspected and maintained to prevent boat failure.
• Ensuring that there are enough lifejackets for everyone on board.
• Following all weather reports that could affect water conditions.
• Making sure all boating laws are followed by the boat captain.

If boat owners or operators fail to do those things, they could be held liable for injuries if an accident occurs.
