Out Of State Truck Driver Charged In Fatal Accident

In 2017, Arther T. Wells, a 70-year-old man from Mississippi, was driving an eighteen-wheeler through Pennsylvania when he caused a chain-reaction crash that killed Zachary Wilkoski. After an extensive investigation, one that involved reconstructing the entire scene, police have determined that Mr. Wells had “ample time and space to brake and avoid the crash but did not.”

He was arraigned in court in early January on charges of involuntary manslaughter, homicide by vehicle, recklessly endangering another person, as well as other vehicle code violations. While Wells’ attorney says that his client should not have been charged criminally, they will have to show why Wells did not stop despite having 275 feet to realize he was in a dangerous situation.

At SMT Legal, we know that there are many reasons that accidents with large commercial trucks occur. If you have been injured in a crash like this and need a Pittsburgh truck accident lawyer, you can count on us to work diligently while we secure the compensation you deserve.

What Can Happen?

In the case above, we will be awaiting the final results of this case. It will likely go to trial. Right now, though, we can still wonder why the driver did not slow down. Was he distracted?

When we look at why large truck accidents occur, we have to examine possible driver error because there are times when a driver is negligent in their duties.

  • They ignore laws and regulations regarding how long they can drive in a day or how much weight they can carry at one time.
  • They drive impaired by drugs or alcohol.
  • They operate while distracted by their phones or other devices.

We also know that vehicle failure is to blame for many truck accidents. This occurs when a truck company or owner fails to regularly inspect and maintain their vehicles. This can lead to problems with the following systems:

  • Powertrain
  • Brake system
  • Suspension
  • Steering
  • Tires/wheels

If a driver loses control of their vehicle because of a mechanical problem, or if they are operating negligently, the potential crash could be devastating. Commercial trucks are large and can cause major injuries. If they are transporting flammable or hazardous materials, the potential for major damage increases.
