Pennsylvania is a proud state of mixed terrain. From its urban centers to its vast rural towns, Pennsylvania literally has everything for someone who is looking to stay close to a city, but enjoy the fresh air of the country life. Pittsburgh area is surrounded by gorgeous rural areas with an abundance of trees and trails. Not just any trails, but ATV trails. ATVs are widely used in Pennsylvania. From farmers to midnight fun, ATVs allow users to cover a vast amount of territory in little to no time. As fast and fun as these vehicles are, they are dangerous. Our Pittsburgh ATV accident lawyers at SMT Legal has the privilege of representing clients who have been injured due to the negligence of some ATV rider. These injuries vary from minor to severe, but the one thing all cases have in common is the pain and suffering a family deals with when a family member is trying to recover from an accident that isn’t their fault.

Youth & Tragedy

In Union Township, about 15 miles from Pittsburgh, three young ones decided to play around on an ATV. The youngest of the three was an 8-year-old girl who sat with a 16-year-old girl. The driver of the ATV was an 11-year old boy. Clearly, these three were friends and were looking to have a fun afternoon together. ATVs are a norm in families who live and work in the country. For someone so young to be on an ATV is not far fetched. However, just because these children felt comfortable with a vehicle does not mean that they are prepared to ride one.

While driving, the 11- year old boy attempted to make a left turn on a gravel road at a high speed. This action resulted in the ATV flipping sideways, then completely rolling over, and finally, it tipped over pinning down the 8 and 16-year-old passengers. Needless to say, the 8-year-old did not survive. Once the police were altered, medical help sent the 11 and 16-year-old to the hospital for severe injuries.

The news report did not state if the children were wearing helmets. It is illegal to operate an ATV without a helmet. However, if you opt not to wear one the punishment is a fine. Children under 16 are not allowed to operate an ATV. It is unknown why these children were riding an ATV, but what is clear is that several laws were broken and one little girl is dead.
